Starting this year, CMS has included agents and brokers in their definition of a TPMO (third-party marketing organization) and set forth new rules for TPMOs.

Through secret shopping CMS has identified areas of concern related to the marketing and sales activities that occur with Medicare beneficiaries.

CMS confirms it has no plans to delay implementation of the 2023 Medicare Advantage and Part D final rule that cracks down on aggressive MA marketing tactics, despite calls to do so from health insurance agents and brokers who object to being included in the definition of a third-party marketing organization (TPMO).

On May 9, 2022 CMS published a final ruling announcing policy and regulatory revisions for Contract Year 2023. Among the changes are requirements for disclaimers and call recording. Required implementation of these measures begins October 1, 2022.

On February 9th, 2022, CMS provided an updated Medicare Communications and Marketing Guidelines (MCMG) document for Medicare Advantage (MA) plans, section 1876 cost plans, and Medicare Prescription Drug Plans. These requirements also apply to Medicare-Medicaid Plans (MMPs), except as modified in state-specific marketing guidance for each state’s demonstration. View the post for the full update.
